PetCurious currently provides users with pet locating resources (the "Service"). You understand and agree that the Service may include advertisements and that these advertisements are necessary for PetCurious to provide the Service. Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new PetCurious properties, shall be subject to the terms of use.

You understand and agree that the Service is provided "AS-IS" and that PetCurious assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

PetCurious is not responsible if the information that it makes available on this website is not accurate or complete. Any reliance upon the material on this website shall be at your own risk. You agree that it is your responsibility to monitor any changes to the material and the information contained on this website.

3. MEMBER ACCOUNT, PASSWORD, AND SECURITY
In consideration of your use of the Service:
1. You must be at least 18 years of age.
2. Provide accurate, current and complete information about yourself as requested in the Service's membership form. If you provide any information that is inaccurate or is not current, PetCurious has the right to suspend or terminate your account and refuse any and all current or future use of the service.

You will be given an account and a password upon completing the Service's membership process. You are responsible for managing and maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to immediately notify PetCurious of any unauthorized use of your password or account or any other breach of security, and ensure that you properly log off from your account at the end of each session. PetCurious will not be held accountable for any loss or damage arising from your failure to comply with these terms as detailed in the Member Account, Password and Security section.

You must agree to the additional terms provided under the User Generated Content Terms and Conditions as part of your membership agreement.

4. FEES AND COSTS
PetCurious allows user to browse animals for sale or adoption, and to contact subscribing sellers and shelters for free. While it is free to list a pet for sale, a paid subscription is required in order for sellers or shelters to communicate with perspective buyers. A complete description of PetCurious Fees is available on PetCurious Fee Structure Table. Fees to become a subscribing seller range from $20 to $40. Sellers and shelters may choose to be billed monthly, with the payment due 30 days from the invoice date.
The date PetCurious creates your invoice depends on when you first pay for your subscription, and cannot be changed. PetCurious also cannot change your payment due date.

To terminate the recurring billing process the seller may opt out, upgrade, or downgrade at any time via the billing page. Otherwise, recurring charges will continue to be billed regardless of the seller's account activity.

5. SUBMITTED CONTENT; INTELLECTUAL PROPERTY RIGHTS
PetCurious can claim ownership of the Content you submit or make available for inclusion on the Service. With respect to Content you submit or make available for inclusion on publicly accessible areas of the Service, you grant PetCurious the following world-wide, royalty free and non-exclusive license(s), as applicable:

With respect to Content you submit or make available for inclusion on publicly accessible areas of PetCurious, the license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display such Content on the Service solely for the purposes of providing and promoting PetCurious.

With respect to Content other than photos or video you submit or make available for inclusion on publicly accessible areas of the Service, the perpetual, irrevocable and fully sublicensable license to use, distribute, reproduce, modify, adapt, publish, translate, publicly perform and publicly display such Content (in whole or in part) and to incorporate such Content into other works in any format or medium now known or later developed.

"Publicly accessible" areas of the Service are those areas of the PetCurious network that are intended by PetCurious to be available to the general public. However, publicly accessible areas of the Service does not include private communication such as PetCurious Room-mail.

All copyright, trademarks and other intellectual property rights in all text, images and other materials on this website are the property of PetCurious or are otherwise included with the permission of the relevant owner.
You are permitted to browse this website, reproduce extracts by way of printing, downloading to a hard disk or for the purposes of distribution to other individuals. PetCurious may also in its sole discretion and at any time discontinue providing the Service, or any part thereof without notice. You agree that any termination of your access to the Service under any provision of this Terms of Service may be effected without prior notice, and acknowledge and agree that PetCurious may immediately deactivate or delete your account and all related information and files in your account. PetCurious is not liable to you or any third-party for any termination of your access to the Service.

If PetCurious permits or makes available to you the ability to: (a) upload content to the website via your mobile telephone and/or tablet (‘mobile device”), (b) receive and reply to messages, or to access or make posts using text messaging, (c) browse the site from your mobile device or (d) to access features through a mobile application you have downloaded and installed on your mobile device (collectively “Mobile Services”), your mobile carrier’s standard data, Internet, messaging and other service fees and charges apply to your use of, and access to, the Mobile Services, and you are solely responsible for all such fees and charges. The Mobile Services may not be compatible with all mobile devices, carriers, and services, and PetCurious does not make any representations or warranties regarding such compatibility. You understand that content delivered as part of the Mobile Services may be delivered to your device through premium mobile services and acknowledge that you are solely and exclusively responsible for any charges for such services, including but not limited to any roaming charges.

You understand that you may be charged by your wireless service provider in connection with the receipt of such messages. You may “opt out” of receiving future messages by following the instructions provided (i) in the wireless messages or (ii) on the website where you registered to receive such messages.

By creating an PetCurious account, you are to opting in to receive account and marketing SMS and MMS messages from us. By providing your phone number and opting-in to receive SMS and MMS messages, you agree to the following terms and conditions:

Message and data rates may apply. Depending on your wireless carrier and plan, you may be charged for each SMS and MMS message that you receive. We are not responsible for any charges incurred from receiving SMS and MMS messages from us.

You can opt-out of receiving SMS and MMS messages at any time. If you no longer wish to receive SMS and MMS messages from us, you can opt-out by replying "STOP" to any message you receive or by contacting us directly. Please note that it may take up to 48 hours for your request to take effect.
We reserve the right to modify or terminate this service at any time. We may add, remove, or modify the types of SMS and MMS messages that we send, or we may terminate the service altogether. We will provide notice of any changes to the service as required by law.

We respect your privacy. We will only use your phone number for the purpose of sending you SMS and MMS messages related to your Authorized account. We will not share your phone number with any third parties for marketing purposes.

This website is located in and operated from the United States of America. Your use and access to this website will be governed by the laws of the United States. You and PetCurious agree that any controversy or claim arising from or pertaining to the use of this website shall be governed by the laws of the State of California, United States of America, without giving effect to its choice-of-law provisions, and be submitted to the exclusive jurisdiction of the courts of San Francisco County, State of California, United States of America.

16. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy constitutes all the terms and conditions agreed upon between you and PetCurious and supersede any prior Terms of Service, whether written or oral. Any additional or different terms or conditions in any written or oral communication from you to PetCurious are void. You agree and accept that you have not accepted these Terms in reliance of or to any oral or written representations made by PetCurious not contained or referenced in this Agreement or the Privacy Policy.
